CONTEMPORARY LEGAL ISSUES: THE SUMMARY JURY TRIAL
An ever increasing amount of litigation has clogged court dockets, resulting in greater emphasis being placed on alternative methods of resolving disputes. Under the ADR umbrella, a variety of processes such as negotiation, mediation and arbitration exist as an alternative to civil litigation. The judiciary has the authority under state and federal rules of civil procedure to fashion methods to encourage litigants to settle disputes rapidly. This program discusses the Summary Jury Trial, a court-supervised, hybrid process which encourages the parties to settle their disputes rather than adjudicate them in court.
